The Flexmail service is intended for businesses and professionals and is provided by Flexmail nv, a company belonging to our Group. By placing an order, you accept this Service Order together with the Terms and Conditions of NOMINALIA INTERNET S.L. (https://www.nominalia.com/quienes-somos/condiciones-legales/ccs-condiciones-generales-nominalia/?lang=en/), which govern the supply and provision of the Services.



In addition to these terms, you also accept Flexmail’s Terms and Conditions (“Flexmail Terms”), available at https://flexmail.be/en/terms-and-conditions/.



1. Definitions
“Service(s)” means the Flexmail services provided and made available for purchase through us, as listed at https://www.nominalia.com/flexmail/?lang=en. The Services offered by us may differ from the products specified in the Flexmail Terms.



2. Purchase of the Service
To purchase the Service, you may place an order through our website, log in to your Control Panel or contact our sales team on +34 93 288 40 62. Advance payment for the Service is required both for the initial purchase and for any subsequent renewal.



3. Technical Support
Initial technical support for the Service will be provided by us. You may request support through your Control Panel or by calling the telephone number indicated above.



4. Consequences of Termination
In the event of termination for any reason, we will cease providing the Services and delete all relevant data from your account within 60 days. For the avoidance of doubt, this deletion will include, among other things, all records, documentation, files and data, if any, associated with the Service.



5. Use of the Services
The User acknowledges that the Service is provided “as is”. The technical and financial specifications relating to the functionality and proper use of the Service are set out in the Order Form and in the commercial offer issued by Nominalia Internet S.L.U.



6. Agreement
Under no circumstances shall we be held liable for, among other things, any claim, liability, damage, third-party claim, cost, expense, including legal fees, penalty or issue arising out of or in connection with the purchase or implementation of the Services on the User’s websites.



7. Governing Law and Dispute Resolution
Without prejudice to the provisions of the aforementioned contractual terms and conditions of Flexmail N.V., any dispute arising in any way out of or in connection with this Service Order, including any dispute relating to its validity, binding effect, interpretation, performance or termination, as well as any amendment to or act of enforcement thereof, shall be subject to the exclusive jurisdiction of the courts of Barcelona.
