TERMS AND CONDITIONS “Website Creation and Launch Guarantee”

1. Purpose

These terms and conditions govern the promotion called the “Website Creation and Launch Guarantee” (hereinafter, the “Guarantee”), applicable on Nominalia.com during the period between April 14 and May 4, 2026, exclusively in relation to the products or bundles expressly identified as eligible on the promotion page or in the relevant commercial offer.

Through this promotion, the provider offers the customer additional assurance for the initial purchase of WordPress hosting services (managed and unmanaged), ensuring that, if the customer is unable to create and publish a basic website in accordance with these terms within thirty (30) calendar days from the date of purchase, the customer may request the application of the Guarantee.

Provided that all the requirements set out in this document are fully met and once the support process referred to in clause 7 has been completed, the Guarantee shall entitle the customer to:

• A full refund of the amount actually paid for the eligible service, in accordance with clause 8.
• A bonus or voucher in the amount of €50, not redeemable for cash, for the purchase or renewal of the provider’s services, in accordance with clause 8.

This promotion is intended to convey that the customer will be able to create and publish with us a basic website using the tools included in the service, including the AI-assisted website builder, with the support of the support team and, where applicable, with the additional technical assistance provided for in these terms. Accordingly, if the customer is unable to create and publish such basic website within thirty (30) calendar days from the date of purchase, despite having made diligent use of the available tools and having completed the support process set out in clause 7, the customer shall be entitled to a full refund of the amount actually paid for the eligible service and to a bonus or voucher of €50 for the purchase or renewal of the provider’s services, in accordance with clause 8.

2. Scope of Application

The Guarantee shall apply exclusively to:
• New customers purchasing for the first time an eligible WordPress hosting service.
• Existing customers purchasing a new eligible WordPress hosting service, provided that it is not linked to a previously developed website project and does not constitute the renewal, upgrade or reactivation of an existing service.

The Guarantee shall not apply to renewals, migrations of existing websites, previously active services, products not identified as eligible, domains, add-ons, licences or additional services not expressly included in the promotional bundle.

3. Scope of the Guarantee

The Guarantee exclusively covers the possibility of creating and publishing a functional website providing a basic online presence:
• Using the tools included in the purchased service, including the AI-assisted builder and, where applicable, the installer or equivalent resources made available by the provider.
• Within a maximum period of thirty (30) calendar days from the purchase date of the eligible service.
• With diligent use of the service by the customer and with the corresponding interaction and cooperation with the support team.

The Guarantee is limited to the publication of a basic website and does not include custom developments, advanced outcomes or the achievement of commercial, creative or technical objectives other than putting such basic website online.

4. Definition of a Valid Website and Content Provision

For the purposes of the Guarantee, the objective shall be deemed to have been met when the customer has published a website that:
• Is accessible from an active domain correctly pointed to the purchased service.
• Contains customised and substantive content, that is, text, images, data or elements other than empty, sample or default content.
• Is consistent with the customer’s actual personal or professional activity.
• Includes, at a minimum, a homepage, a contact section or form, and at least one additional page.

The Guarantee covers the ability to create and launch the website, not its level of finish, design, sophistication or degree of customisation.

Unless expressly included as part of an additional service, the provider shall not draft or provide the customer’s customised content, including, without limitation, corporate texts, own images, logos, catalogues, business data, legal texts, translations or any other material subject to customer validation. The availability, accuracy, lawfulness and suitability of such content depend exclusively on the customer.

The customer warrants that it holds all rights, authorisations and legal bases necessary in relation to the content, distinctive signs and materials it provides for the creation or publication of the website.

5. Exclusions

The following are expressly excluded from the scope of the Guarantee:

5.1 Design and Visual Experience
• Customer satisfaction with the design, aesthetics, visual identity, tone of the texts or user experience.

5.2 Results or Performance
• Commercial results, customer acquisition, traffic, SEO positioning, conversions, revenue, perceived speed or any other performance metric.

5.3 Advanced Functionalities
• Custom developments, ecommerce, advanced or customised integrations, complex automations, migrations, non-standard configurations or features not natively included in the purchased product.

5.4 Complex or Out-of-Scope Projects
• Projects exceeding a basic online presence website or requiring architecture, content creation, legal review, layout work, photography, branding or complex parameterisation.

5.5 Circumstances Not Attributable to the Provider
• Delays, blockers or impossibility of publication resulting from lack of customer cooperation, failure to provide content, absence of validations, third-party incidents, external configurations, domain registry restrictions, issues unrelated to the purchased service, or force majeure events.
• Requests relating to unlawful, prohibited or third-party rights-infringing content, or content contrary to the provider’s policies.

6. Eligibility Requirements

In order to benefit from the Guarantee, the customer must cumulatively meet all of the following conditions:

6.1 Effective Use of the Service
• Have started using the eligible service within the guarantee period.
• Have genuinely and reasonably used the tools included in the service, including the builder, installer or any equivalent available resource.
• Have created at least one draft of the website with sufficient customised content to allow its review and possible publication.

6.2 Interaction with Support
• Have contacted technical support through the official channels indicated by the provider within the guarantee period.
• Have clearly described the issue, blocker or limitation preventing the creation or publication of the website.
• Have followed the reasonable instructions provided by support and made reasonable attempts to implement them.
• Have provided, where necessary, the minimum information, access credentials, authorisations and materials required for the provider to assist the customer or, where applicable, create the basic website on the customer’s behalf.

6.3 Explicit Request
• Explicitly request the application of the Guarantee within thirty (30) calendar days from the date of purchase.
• Accept these terms and conditions.

6.4 No Prior Publication
• Have failed to publish a functional website meeting the requirements of clause 4 during the guarantee period.

The Guarantee shall not apply where the inability to publish is primarily due to lack of content, lack of customer response or validation, or the customer’s refusal to accept reasonable solutions proposed by the provider in order to launch a basic website.

7. Request, Support and Resolution Procedure

Before any refund or issuance of the bonus, the customer must complete the support process set out in this clause.
• The request must be submitted within thirty (30) calendar days from the purchase date of the eligible service and must include, at a minimum, the order identifier, the purchased service, the associated domain and a description of the existing blocker.
• Upon receipt of the request, the provider shall open a case file and may review objective records of service usage and interaction with support in order to verify compliance with these terms.
• The provider shall provide guided support, may propose alternative solutions and may request that the customer provide content, access credentials or validations that are essential.
• As a priority measure to fulfil the objective of the promotion, the provider may offer to create or configure a basic website on behalf of the customer using minimum content provided or approved by the customer.
• If, through such process, the basic website is published in accordance with clause 4, the Guarantee shall be deemed to have been properly fulfilled and no refund or additional bonus shall apply.

The assessment of the case file must be carried out in accordance with objective and documentable criteria and may not be based solely on an unreasoned discretionary decision.

8. Compensation

Once the procedure set out in clause 7 has been completed, the customer shall be entitled to the compensation indicated in this clause only where the provider objectively verifies that:
• All eligibility requirements set out in these terms have been met.
• The customer has not succeeded in publishing a basic website in accordance with clause 4 within thirty (30) calendar days from the date of purchase.
• The inability to publish is not attributable to any of the exclusions set out in clause 5 or to any lack of cooperation on the part of the customer.
In such case, the provider shall grant the customer:
• A full refund of the price actually paid for the eligible WordPress hosting service covered by the promotion. Amounts corresponding to domains, professional services, add-ons, third-party licences, taxes, fees or ancillary services shall be excluded from the refund unless they are expressly indicated as an inseparable part of the promotional bundle.
• A bonus or voucher with a nominal value of €50, personal and non-transferable, not redeemable for cash, usable for the purchase or renewal of the provider’s services within the validity period indicated in the issuance communication or on the promotional page.
The bonus may be subject to reasonable usage restrictions, such as minimum purchase amounts, excluded categories, non-cumulability with other promotions or use in a single transaction, provided that such conditions are clearly communicated to the customer before or at the time of issuance.

9. Limitations and Usage Control

The provider may verify compliance with these terms by means of service usage records, support tickets, timestamps, domain status, installation history, technical access logs and any other objective evidence linked to the case file.

The Guarantee shall be limited to one approved request per customer and per eligible service during the validity period of the promotion. For fraud or abuse prevention purposes, the provider may take into account reasonable matches of ownership, account, email address, payment method, tax details or equivalent elements.

The provider may reject the request where any of the following circumstances apply:
• Failure to comply with any of the requirements set out in these terms.
• Provision of false, incomplete, contradictory or misleading information.
• Creation of duplicate accounts or artificial use of multiple identities for the purpose of multiplying the promotional benefit.
• Fraud, abuse, bad faith or use of the service for purposes other than the creation and publication of a basic online presence website.
Any rejection of the request must be based on verifiable facts and on a sufficiently clear explanation provided to the customer.

10. Acceptance, Amendments and Acquired Rights

Participation in the promotion implies full acceptance of these terms and conditions.
The provider may amend, suspend or cancel the promotion for justified reasons, provided that such amendments do not have retroactive effect on requests validly submitted during the validity period of the promotion and do not adversely affect rights already acquired by customers under the
