Mailbox Exchange

This Service Order ("SO") forms an integral and substantial part of the General Service Conditions ("GSC"). The GSC and this SO establish the terms and conditions for the supply of the Mailbox Exchange Service ("Exchange Service") by Register.it to the Customer. Upon Customer's acceptance, the offer published on-line constitutes an integral part hereof.

DESCRIPTION OF THE EXCHANGE SERVICE
The Exchange Service includes the following:
- number of Exchange mailboxes on the Customer domain name equal to the number indicated in the offer;
- mailbox space associated with the individual Exchange mailbox, also defined in the offer;
- mailbox space which can be shared with other users pursuant to the offer;
- OWA (Outlook Web Access) service on secure address (https). This service enables access to a certified SSL address from which it is possible to access customer's Exchange mailbox after authentication

OBLIGATIONS OF REGISTER.IT
The request for activation by the Customer of an Exchange mailbox shall involve on the part of Register.it exclusively the performance of the following activities: (i) the setting up of a dedicated third-level domain (in the form exchange.domain.tld). This third-level domain identifies the mailbox space and the relative quota, on Register.it's dedicated mail server ; (ii) the creation of the relative MX mail record; (iii) mailbox activation on the Exchange 2003 server in the form username@exchange.domain.tld; (iv) activation of username@domain.tld as forward of username@exchange.domain.tld (v) disk space maintenance.
Register.it does not provide any assistance relative to the installation and use of the Exchange Service purchased by the Customer. This information may be obtained by the Customer directly from the on-line Guides contained in the program provided.

OPTIONS AND CONDITIONS FOR THE SUPPLY OF THE EXCHANGE SERVICE
The conditions for the supply of the Exchange Service by Register.it are the following:
- the existence of a Customer Domain Name maintained by Register.it in its capacity as Maintainer, Registrar or Reseller may in fact be utilized exclusively as an additional service to the Domain maintained by Register.it;
- use for the Domain name of the authoritative DNS of Register.it;
- standard set-up of the MX record in the DNS configuration (or on the Register.it dedicated mail server).
- maintenance of the mailbox as an Exchange mailbox.
The conditions specified above shall remain in force for the entire duration of the supply of the Exchange Service. The Customer declares that he is aware that should one or more of the aforesaid conditions cease to exist this will prevent the possibility of utilizing the Exchange Service. The Customer is therefore informed that, should during the term of this agreement the Customer not renew or transfer the relative Domain Name to another Maintainer or configure the relative Domain Name on an authoritative DNS other than a Register.it one, or change the configuration of the mail record, or in case of change of the Exchange mailbox into POP3 or Forward, the supply of the Exchange Service will become for Register.it technically impossible and, accordingly, it shall be immediately terminated, without prejudice to Register.it's right to claim payment for the entire consideration provided for the Service.
The Customer also declares that he is aware of the fact that all the functions of the Exchange mailbox shall be available only in the case of use of the mailbox through an OWA access. N.B. remote mail clients with an IMAP server configuration other than Outlook 11 are not enabled for synchronization of all the functions of the service. Accordingly, the use of the mailbox through OWA is recommended. Register.it specifies that it will provide information thereon directly on the Register.it site
The Customer may modify the user name of the Exchange mailbox initially requested through its control panel at any time. This request involves the activation of a new Exchange mailbox which replaces the previous one with the consequent automatic elimination of the contents of the modified mailbox. Accordingly, Register.it recommends making a back-up of the contents of the mailbox before modifying the user name.

LIABILITY OF REGISTER.IT:
The requests for activation/modification of the Exchange mailboxes shall be active 48 business hours after the request. Register.it shall not be liable for any interruptions of the service attributable to third parties. Moreover, it may interrupt the supply of the service at any time, in case of reasonable safety and/or confidentiality reasons, in which case it shall inform the Customer thereof.
Register.it shall not in any case be held liable for malfunctionings of the Exchange Service attributable to events which are beyond the reasonable control of Register.it such as, but not limited to: (i) events of force majeure; (ii) events depending on third parties' acts such as, but not limited to, the interruption or malfunctioning of the services of the telecommunications operators and/or of the power lines; (iii) malfunctioning of the terminals or of the other communications systems utilized by the Customer.

CLAIMS: the Customer is bound to notify any problems occurring in the service attributable to Register.it through its own control panel within 48 hours of the occurrence thereof. The non reporting of problems in the ways and in the times specified above shall release Register.it from all and any liability.

SIZE AND NUMBER OF THE MAILBOXES: the number of mailboxes which may be activated by the Customer and indicated in the offer, the associated mailbox space and the shared mailbox space cannot be exceeded. The Customer will have the possibility of purchasing additional electronic mailboxes and additional disk space, based on the packages offered and through his Control Panel, at the cost applied by Register.it at the time of purchase of the additional package. The terms and conditions for the use of the additional packages shall be the same as those contained in this SO. Should the main agreement or the Exchange Service be terminated, this shall automatically involve the termination of the purchased additional services, without prejudice to Register.it’s right to claim payment for the entire consideration provided for the additional services. The Customer shall be solely and exclusively responsible for the periodic erasure of the messages from the server, so that the full use of the available space does not cause the blockage of the mailbox.

DATA: all the data and contents sent and/or received by the Customer from or through the Exchange Service are and remain the sole property of the Customer. Accordingly, the Customer takes on all and any liability over such data and their content.

UTILIZATION RULES: the Customer undertakes not to utilize the Exchange Service for unlawful purposes, to observe the utilization rules for the individual Services indicated in the SOs, and not to breach in any way any of the applicable national and international rules, including regulatory ones. The Customer moreover undertakes to observe Netiquette's rules available at the address http://www.nic.it/NA/netiquette.txt.
In particular, the Customer warrants that he will not carry out directly and/or indirectly any spamming, that is to say the sending, by e-mail, of unauthorized communications or communications which have not been requested and/or solicited by the recipients. Register.it emphasizes that this practice is forbidden both by the Netiquette rules and by D.Lgs 196/03 on the protection of privacy. Register.it moreover emphasizes that it shall hold the Customer liable even should the unlawful spamming activity be effected also through mail addresses different from the one purchased by Register.it and involve even indirectly a Register.it Service or Register.it's technical structure directly (e.g.: unauthorized promotion of an internet site hosted by Register.it).
Register.it reserves the right to immediately suspend the Service, at its sole discretion or following a third party report , should it believe that the Customer is carrying out activities in breach of the obligations provided in this article through the Service. In such case, the Customer, following a report even by e-mail by Register.it, shall immediately eliminate the reported actions or provide suitable documentation proving that the actions carried out by him are in compliance with the laws in force. In the absence of an immediate response, Register.it shall be entitled to terminate the agreement immediately without prejudice to the right to claim full payment of the consideration and Register.it's right to take action to claim full compensation for any damages which may have been suffered.

EQUIPMENT: Register.it does not provide any equipment to the Customer.

TERM
As decided by the Customer during the purchase procedure or afterwards, from his toolbar, this SO may expire a) with or b) without tacit renewal.
a) In the case of expiration with tacit renewal and credit card payment, the consideration set forth in the following article "Consideration and Payments" will be billed directly by Register.it to the Customer's credit card, in accordance with the terms and conditions in effect at the time of renewal, as illustrated on the toolbar following notification via e-mail. If Register.it cannot bill this charge, the agreement cannot be tacitly renewed and will be considered definitively expired at the envisaged expiration date. In this case, the Customer may renew the service by following the procedure described hereunder at . In the case of expiration with tacit renewal and payment with a system other than credit card, 20 days before the expiration date Register.it will execute the renewal and send the invoice to the Customer. This invoice must be paid in accordance with the terms set forth therein. The invoice and payment instructions will be sent via surface mail to the address recorded in Register.it files at the time of the order. If the Customer does not make payment by the envisaged deadline, Register.it may interrupt the service at any time, except as envisaged in Article 6 of the General Conditions of Service.
b) In the event of expiration without tacit renewal, the Customer may request that Register.it, through the online procedure provided by Register.it, to renew the service with this SO for additional, subsequent periods by the deadlines appearing on the Customer's toolbar and at the technical and economic conditions in effect when the service is renewed, executing the renewal procedure. If it is not renewed in the forms and by the deadlines indicated above, when this SO expires, it will lawfully cease to have any effect, without it being necessary for Register.it to send any further notices.

CONSIDERATION AND PAYMENTS
The Consideration for the Exchange Service is that indicated in the offer. Any Consideration is to be intended net of VAT, unless otherwise specified.
The payment of the consideration for the Exchange Service shall be made by credit card, filling in the payment form during the registration procedure.
